The Hershey’s company mission is â€Å"Bringing sweet moments of Hershey happiness to the world every day. † Hershey’s mission statement is short and sweet. They are able to address the majority of the nine components of the mission Statement with one sentence. Their customers are the world, their product is Hershey, their market is the world, their philosophy is to bring happiness, and their self-concept is that they perceive themselves as a company that can bring happy moments to individuals who use their products across the world everyday. There are nine component of mission statement ,whisch is Customers, Products/Services, Geographic Markets, Technology, Concern for Survival, Philosophy, Public Image and EmployeesDistinctive Competence. The mission statement needs to include some description of the function of the business. For example, â€Å"to promote industrial excellence,† tells customers and employees nothing. A more effective description would be â€Å"To provide management consulting services. † An effective mission statement sets out, in broad terms, the target market. A manufacturer that makes nuts and bolts might set its target market as retail hardware stores, machine manufacturers, or both. The business must determine what region it serves best and relay that information by way of the mission statement. A garage, for example, might limit its target region to the community while a magazine company might target an entire country. Mission statements typically include a statement of company values. Values such as customer service, efficiency and eco-consciousness often appear on lists of company values. At their best, company values should express principles the company explicitly tries to affirm in day-to-day operations. For businesses that rely heavily on technology, the mission statement should include a description of the essential technology the company does or plans to employ. If nothing else, this directs purchasing agents toward the appropriate vendors for goods and services. Every company has a policy regarding its relationship with employees. A mission statement provides an opportunity to describe that policy in brief so employees know the essentials of where they stand. Effective mission statements also include a brief description of the business’s strategic position within the market. For example, the company might excel at serving residential clients and seek to maximize that strategic advantage. For for-profit ventures, businesses require clear financial objectives. A start-up company might set one of its financial objectives as making an initial public offering of common stock within two years. This lets the employees and potential investors know the company intends to go public, with all of the legal and record keeping ramifications that entails. Like people, companies develop public images. Careful companies craft the public image they want to establish and lay out the major features of it in the mission statement. This helps managers direct employees that stray from the sanctioned public image. Firstly, Hersheys company try to give an effort on promoting the health benefits of their product to shared it with thier customer. Based on Specific, Measurable, Attainable, Responsible person and Time specific (SMART) Hersheys Company not follow the technique wisely. For the Specific part, Hershey company fail to specific their goals. They must try to answer the questions of how much and what kind with each goal writen. On part Measurable, the company must set the goals that stated in quantifiable terms, or otherwise they’re only good intentions. Measurable goals facilitate management planning, implementation, and control. Hershey shown the implement to getting the customers that has mind-set of chocolate is a healthy junk food. Besides that, the third aspect of SMART technique is Attainable that talk about the goals must provide a stretch that inspires people to aim higher and make sure the goals must be achievable, or they’re a set-up for failure. For the Hershey company, they objective or goals that want to change customer mind-set about taking chocolate is a good habits that inspired their customers to increase their loyalty. Fourth aspect is the responsible person or group of department to take the responsibility to run the objectives. The goals must be assigned to a person or a department. But just because a person is assigned to a goal doesn’t mean that she’s solely responsible for its achievement. Hershey company did not state clearly who or what department must take the important part of implement the objective of the company. Lastly, aspect of time specific which is reference to time, the goals must include a timeline of when the goals should be accomplished. The Hershey did not state it in their objective. This is make the goals can become flexible to achieve that never based on time setting. Besides that, Hershey company also has their own strategy as an backup of their objective which is entering new market in Canada, United States, Mexico,Brazil and other international locations(India,The Philippines ,Japan and China), producing new products with new brand name, expanding its global presence via joint venture and merger, supporting environmental and social projects, increase sales using promotional materials and the last is roducing healthy chocolates.

The development of political thought was always close-knit with the author’s epoch and regime of governance he lived under; however, in spite of the ethical and technological limitations, associated with the temporal factor, the majority of political scientists sought to build a universalized framework of justice and legitimate state power.John Rawls is distinguished for his positivist, or â€Å"realistic utopian† approach to justice and principles of peaceful coexistence among individuals as well as peace between government and population. However, the proportion of utopianism is much higher in his writings, as compared to the realism ratio, given that he fails to address the challenges, related to diversity and class inequality which are dominating the modern North American society.First of all, it is important to pay attention to Rawls’s dynamic and positivistic model of justice. According to the article, instead of seeking the ideal of justice beyond the exis ting order of affairs, the scholar tries to enable reasonable and gradual improvements of the internal structure and situation: â€Å"We can see this idea through the rather well-worn metaphor of the difference between the efforts needed to fix a boat that is at sea one plank at a time rather than trying to rebuild it from scratch. Generally speaking, it makes more sense to engage the first sort of repair job than a complete rebuild† (Mini-lecture, p.4).Interestingly, the author focuses predominantly on the strong points of the current ideas of justice as articulated both in legal terms and through societal behaviours.However, this task might appear extremely challenging given the focus of diversity in most European and North American policies. For instance, in the United States, there are several large Muslim communities, whose polity greatly resembles the lifestyles of Middle Asian societies. The U.S.-based communities might engage with political activity and unite into a faction, requiring, for instance, the cancellation of women’s right to take certain jobs, and referring to the fact that the existing state-of-art offends their vision of gender morality.Surprisingly, this faction might be supported by other political groups, which also share this view on gender equality – as a result, the society might be torn by the deba te over the true justice. As one can notice, the representation of the core values of liberty might be uneven in our society, so both federal and state legislations necessarily challenge the beliefs of a certain minority.  Furthermore, Rawls’s concept of justice and stability is quite unrealistic, since it provides an abstractive picture, barely imaginable in the current world. According to the political philosophy article, â€Å"His core insight is that a stable and enduring society is one that is also just, that is, where citizens are considered to be free and equal. More importantly, citizens have to be able to see themselves and each other as free and equal† (Mini-lecture, p.6).However, inequality is inescapable, it is often referred to as an engine of social and political development, which motivates individuals to participate in political processes. The true equality, as articulated in the paper, consists in people’s outlooks and convictions, yet the for mation of â€Å"equality beliefs† is normally realized only partly, since there still exist economic, social, regional, gender and age boundaries which make people feel underprivileged or superior.In this sense, Rawls refers to Kant and observes that the greatest political ideas were realized from the personal to the public, i.e. if an individual considers certain pattern ‘fair’, this pattern is likely to appear to be ‘fair’ in the whole society.However, this logic of reasoning fails to take into consideration the fact that the idea of equality was first born in autocratic societies, bearing much higher uniformity within its aristocratic and power circles, as compared to the modern Western world. Baseball is North America's oldest and most storied professional team sport. Certainly, there have been numerous moments which are still remembered by baseball fans of all ages many years after they happened. We all remember moments like "The Catch" in Game 1 of the 1954 World Series and Bill Mazeroski's World Series winning home run in 1960. There are also the players who transcend the ages like Babe Ruth, Ted Williams and Jackie Robinson. These players continue live on in the hearts and minds of the nation long after their playing days are over. The great players, teams and memorable moments of the 20th century are well remembered, but somewhat less known are those of the 19th century that helped to shape the game and provide a foundation for the great national pasttime that would develop in the current century. For the great Yankee teams of the 20's, 30's 40's and 50's, there are the St. Louis Browns of the American Association and Chicago White Stockings and Boston Red Stockings of the National League. The Ty Cobbs and Walter Johnsons of the game had their match in Cap Anson, Dan Brouthers and Amos Rusie. Colourful characters like Casey Stengel and Reggie Jackson had their equals in Arlie Latham and Mike "King" Kelly. It has been said that the more things change, the more they stay the same. This is certainly the case in baseball. The franchise shifts, player movements and salary issues of today are certainly not new, although the first half of the 20th century would give that impression. Since the National League began in 1876, at least one major league franchise either moved to a new city, moved to a new league, or has folded every year until 1893. Player movement of the early major leagues occurred quite frequently. Comparing Two Heros - Beowulf and Odysseus Reading through Beowulf I began to compare it to the last great epic I read, Homer’s Odyssey. While the Odyssey and Beowulf are each examples of both historic and modern ideas of heroism, the acts of Beowulf’s hero seem to fit better within its context. Beowulf exhibits many obvious heroic qualities, such as his strength and confidence in battle. These along with more subtle diplomatic actions serve to define him as both a great warrior and leader. Beowulf shows both wit and patience in his swift retort after Unferth challenges his skill. Later, after proving himself by dismembering Grendel, he accepts Unferth’s sword to face Grendel’s mother. This offering can be seen as an act of apology or forfeit on Unferth’s part and reveals another side of the hero: forgiveness. Beowulf did not deny Unferth his repentance, nor did he ridicule him upon his conceit. Sallinger's Catcher in the Rye, is based on the sullen life of Holden Caulfield, a 16-year-old teen-ager is trying to find his sense of direction. Holden, a growing adult, cannot accept the responsibilities of an adult. Eventually realizing that there is no way to avoid the adult life, he can only but accept this alternative lifestyle. What Holden describes the adult world as a sinful, corrupted life, he avoids it for three important reasons: His hatred towards phonies and liars, unable to accept adult responsibilities, and thirdly to enshrine his childhood youth. Holden uses the word phony to identify everything in the world that he rejects or encounters with. People are too talkative, too quiet, or dissimilar. Holden, himself, believes he is this perfect person, but no one believes that he is. This is why Holden believes he is surrounded by "phoniness." For example, Ossenburger of Pencey Prep, emphasizes that "he talked to Jesus all the time, even when he was driving his car." Holden thinks this is a load of crap and asserts, "'that killed me. I just see the big phony bastard shifting into first gear and asking Jesus to send him a few more stiffs" (17). Holden sees why he would pray to Jesus, only to send him some more dead bodies to get more business. Not only do phonies bug Holden, but liars and crooks. Another example is Sunny and Maurice, the elevator boy. Maurice offers Holden a prostitute for the night, "Innarested in having a little tail t'night" (90)? Holden decides to take up on this offer, and later that night, as promi sed Sunny knocks at his door. After entering the room, Holden cannot make a decision to sleep with the prostitute, an example of Holden clinging on to his childhood. He instead pays the prostitute for her trouble getting to his room, but after leaving, she barges back in with Maurice, complaining of how little she got. Maurice roughs up Holden and gets to his money, where Holden thinks more deprecate towards phonies and liars. On the Symbolism of The Scarlet Letter Essay

Introduction: Nathaniel Hawthorne is a great romantic novelist in America in the 19th century. His novel, The Scarlet Letter, is considered as the first American psychological novel written by Nathaniel Hawthorne. It reveals the psychological insight with which Hawthorne proved guilt and anxiety in the human soul. The Scarlet Letter is deeply concerned with ethical problems of sin, punishment, and atonement. The background of the story is set in Salem, Massachusetts, a strictly controlled Puritan town with harsh laws and fierce prejudices. Hester Prynne, a young wife whose husband is presumed dead, is being publicly humiliated for the sin of adultery. The proof of her sin is her baby girl Pearl. She conceals the identity of Pearl’s father to protect him from the harsh judgment of Puritan law. She however is doomed to spend the rest of her life marked as an adulterer by wearing a scarlet â€Å"A† on her chest. Hester’s husband meanwhile has arrived in the colony and taken up practice as a doctor. He makes Hester promise that she will not reveal his identity to anyone. It is the Reverend Arthur Dimmesdale, who is renowned as an especially holy and pious man. Wracked by guilt he starts to show outward signs of serious illness. Hester’s husband under the assumed name Roger Chillingworth moves in begins taking care of Dimmesdale. Chillingworth soon discovers that he is Pearl’s father. For revenge, Chillingworth uses his influence to multiply the feelings of guilt in the minister as a form of emotional torture. At the climax of the story, Dimmesdale confesses his sin and dies. Hester and Pearl leave the colony. Chillingworth’s gets the purpose of revenge but suddenly finds his life meaningless and dies within a year. Hawthorne is outstanding in literary skills, especially in symbolism. In this novel, symbolism runs through the whole novel where the scarlet letter â€Å"A†, the characters of story and the settings are all endowed with a deep symbolic significance. The main symbolism of the novel is represented by the colors, the scarlet letter â€Å"A†, the four main characters and the settings. The wide use of symbolism makes his characters to be recalled embodiment of psychological traits or moral concepts. Few literature works equals The Scarlet Letter in intensity and effective use of images and symbols. Importance of being on time USMC Essay

Being at the appropriate place of duty at the correct time is a very important part of being in the Marine Corps. Being at the right place at the right time for any member of the Armed forces is extremely essential to the defense of the entire United States. Also being at the right place at the right time ensures a steady workplace, and ultimately the reliablity that others have on us. A Marine can not move up in the ranks in the Marine Corps if he or she is constantly late and/or at the wrong place. A Marine who truly wants to succeed in the military must go out of his or her way to get squared away and be on time to his or her place of duty or consequences will be bestowed upon them. This concept goes for any person in any career not just the military. Of course being on time in the Marine Corps is being at your appointed place of duty fifteen minutes prior to the actual time of that was ordered. If some one can not carry out the most simple and most important aspect of being on time as a Marine, he or she will be considered unworthy or unfit to be or become an NCO or even higher in they’re career. Even if a Marine goes above and beyond in in the workplace, in events, is great with physical, and mental, but is not on time and punctual than he or she will never actually succeed in the military. Dependability, accountability, consistency and discipline are all crucially related to being on time. Being early also shows that the individual aims high and has their priorities straight. It is directly related to a Marines appearance, combat readiness, mission effectiveness, and essentially every aspect of military life and responsibilities. Your appreance is the first thing that a leader sees, if you have a bad or no shave, no haircut (for males), tardiness, bad physical appearance, druck or hungover to an extreme. Then automatically you have given off a bad appearance, they dont want to go to you for big things, important things, because you can not even handle the simplest things. If you are unable to complete simple things, then when the time comes how will you even be close to doing something tuely challenging. You may work hard and complete tasks faster than any of your other peers, but if your apprearance is bad, then your leader are not even looking they already have a mindset, a negative mind set. All you have in life is your credablity, once it is gone in one persons eyes, you have to put in way more  effort restoring that, compared to the effort that it would have required to maintain your ablility to be relied on. Failure to be on time not only hinders mission capability and readiness, but also can cost unnecessary life lives in or out of combat. For instance; a Marine is late or does not report at all to his place of duty as ordered. In an extreme case a Marine not being on time to relieve the current Marine on post would cause the combat effectiveness and readiness of this Marine to be greatly reduced. This would be caused by fatigue, or lack of supplies needed. As a result of this Marines combat effectiveness he could be compromised and the security of the area could be over run. This is why being where one needs to be at the correct time will always be one of the most important aspects of being in the military. These things do happen on the battle field, whether it be friendly of enemy. However, This can be avoided by, once again, being on time. This is also why being on time remains and always will be an extreme aspect of military bearing and discipline. If you can not be on time, it is said that you have no discipline. Without discipline there is no way for Marines to efficiently fight and win against the enemy. And if we cannot defeat our enemies then there will no longer be a need for Marines. There is nearly no excuse for being late, or not reporting to your rightful place of duty at the right time. Accountability also goes hand in hand with being on time. Which ranges from being on time for the first formation of the day, being on time to relieve a fellow Marine from his post, or being on time to provide critical reinforcements for a unit that has been weakened and compromised in battle. The were about of a Marine is of extremely important at all times. As people say, how a Marine trains is how a Marine fights. If this term is true someone can only come to the conclusion that if a Marine isn’t on time how can he save and protect the lives of other Marines. He or she can’t be depended upon if they aren’t disciplined enough to be on time every time he is ordered to be. Dependability is the key to discipline and if you cant be on time then you wont be depended on, and you are then useless to others. In other words, in military life there is simply no margin for error regarding  being late or tardiness.

Importance of Couseling Essay

The study was limited to only sixteen secondary schools: thirteen government secondary schools and three mission secondary schools in Benin City with practicing school counsellor(s). In all, there were four hundred and twenty respondents (420). Sex was not a factor in the study. Two four-point Likert type scale questionnaires were used to obtain data for the study. These are: Secondary School Counsellors’ Questionnaire (SSCQ); and Secondary School Students’ Questionnaire (SSSQ). The reliabilities of 0.69 and 0.80 were obtained respectively SSCQ and SSSQ using the Cronbach Alpha Internal Consistency reliability. The findings show that there are insufficient counsellors in schools; inadequate availability of counselling facilities; and that the qualification of guidance and counselling personnel has impact on the quality of guidance services they provide to secondary school students in Nigeria. These findings suggest that these variables will help to promote students’ adjustment in the school and the society at large. Paradoxically, the absence of these variables could precipitate students’ maladjustment. Recommendations on ways of improving guidance and counselling services to promote students adjustment were proffered. Introduction Guidance and Counselling happens to be one of the developments in the field of Education in Nigeria. It became popular with the introduction of the 6-3-3-4 educational system. It is generally accepted that in Nigeria, the organized/formal guidance started in 1959 at St. Theresa’s College, Oke-Ado in Ibadan by some Reverend Sisters, out of concern for the products of their school. They felt that there was need to offer vocational guidance to their outgoing final year students. As a result, the Rev. Sisters invited twenty educated people from Ibadan community who were in different professions and therefore knew more about the emerging world of work than the students and the Rev. Sisters. Fifty-four out of the sixty students benefited from the experts’ advice and were placed in various jobs. The innovation was highly accepted by the society because in later years this group of people, though not trained counsellors, organized career talks, seminars, guidance workshops and lectures for the class five students. Later on, the vocational guidance services spread to other secondary schools outside Ibadan and across the entire federation. The ministry officials became so interested in these organized services that this group of â€Å"Career Advisers† was invited to provide career workshops for teachers and career masters. Eventually the term â€Å"Career Advisers† became a national issue. In an attempt to overhaul the old educational system, towards the needs of the nation, the Nigerian Educational Research Council (NERC) in September 1969 organized a conference on curriculum development. The curriculum conference was followed by a government sponsored National Seminar in 1973 under the chairmanship of Chief S.O. Adebo to deliberate on all aspects of a National Policy on Education using the report of the 1969 curriculum conference as the working document. The conference came up with recommendations for a New National Policy on Education, which the Federal Government accepted and published in 1977 and revised in 1981, 1989 and 2004. With the highlighted changes in the Nation’s educational system, the need for guidance and counselling services in Nigerian secondary schools became more glaring. Consequently, Guidance and Counselling Services became an integral and essential component of the educational process for all students as they progress through the educational system. According to Egbochuku (2008), the aims of school guidance and counselling services, which are based on a developmental hierarchy, are to provide students with: 1. Opportunities to develop knowledge and appreciation of themselves and others; 2. Opportunities to develop relationship skills, ethical standards and a sense of responsibility; 3. Opportunities to acquire skills and attitudes necessary to develop educational goals which are suited to their needs, interests and abilities; 4. Information that would enable them to make decisions about life and career opportunities (: 15). Today, guidance and counselling has gained prominence in t he Nigerian educational system and many people are getting interested in the guidance of youth in making wise educational, vocational and personal/social decisions. Consequent upon the expansion of counselling activities in Nigeria and the need to form a larger association to embrace both counsellors and career masters, the Counselling Association of Nigeria (CAN) was launched on the 11th November 1976. To facilitate efficient management of guidance and counselling services in Nigeria secondary schools, guidance and counselling personnel are being trained in the tertiary institutions and sent to schools to deliver these services. Also, basic courses in guidance and counselling feature in all teachers-education programmes. Prominent among the services rendered by guidance and counselling personnel in secondary schools are Information, Appraisal, Referral, Guidance, Counselling and Planning, Placement and follow-up services for the proper guidance of students. Against this background therefore, the focus of the study is to assess the realities of guidance and counselling services in providing adequate guidance for Nigerian secondary school students. 1.1. Statement of the problem It is assumed that with the increasing complexities in the society, industrial and technological development all going hand-in-hand, the succeeding generation will find it difficult to adjust themselves both to the society, work, family and schools. Failures in proper adjustment to all the facets mentioned could affect the education of young people and expose them to environmental as well as personal problems in development. Guidance and Counselling, as a delivery service, should not be misconstrued as the traditional type that is based on the principles of â€Å"to guide, to direct on a course, to enlighten, or to assist†. This traditional type of counselling was principally carried out in African setting by heads of families, Priests, and church leaders (Olayinka and Omoegun, 2001). Because of the complex nature of Nigerian society, the counselling profession has assumed a wider role. Present day Guidance and counselling is based on the process of helping individuals understand themselves which will lead to the better understanding of the other aspect of their lives (Egbochuku, 2008).   According to the literature, these services are the formalized actions taken by the school to make guidance operational and available to students. These formalized actions typically consist of a set of processes, techniques and functions that serve to carry out the guidance and counselling goals of a particular educational level. For students to be properly informed, they need the assistance of trained guidance and counselling personnel. Hence, the government made it a policy that guidance and counselling should feature in teacher-education programmes because teachers are closer to the students. Furthermore, the department of Guidance and Counselling has been established in most Nigeria Universities to train counsellors at the B.Sc., Master and PhD levels, to equip them with the appropriate counselling techniques to carry out guidance and counselling services in secondary schools. There is need therefore to assess the guidance and counselling services rendered by school counsellors to find out if these services actually provide adequate guidance for students’ development. It is therefore hypothesized that Qualification of guidance and counselling personnel, availability of guidance and counselling facilities, quality of guidance and counselling services will not significantly predict students’ adjustment 1.2. Purpose of the study This study assessed the quality of guidance and counselling services in secondary schools with practicing school counsellors in Edo state. To achieve this, the researcher examined the qualification of personnel providing guidance and counselling services, availability of materials for the successful execution of Nigerian secondary school guidance and counselling services and the impact of guidance programs on students’ adjustment. 1.3. Significance of the study Guidance and counselling is the bedrock for achieving self-actualisation. It is a process of helping individuals to understand themselves by discovering their own needs, interests and capabilities in order to formulate their own goals and make plans for realizing those goals. An analysis of guidance and counselling services in providing adequate guidance for secondary school students is of paramount importance; hence the this study. The result from the study will help in throwing more light on how guidance and counselling services is being implemented in secondary schools in Nigeria and the quality of guidance services received by secondary school students. In addition, it provides information to education planners and school administrators on their responsibility in providing adequate facilities for guidance and counselling services in order for students to receive quality guidance. It also reveals the extent to which guidance and counselling services influence the total development of the potentials and proper adjustment of secondary school students. 2. Methodology This is a survey study using correlational research design. The scope of the study covers some selected government and mission secondary schools with practicing school counsellors in Benin City of Edo State Nigeria. This is because Benin City is a metropolitan city and consists of three well-populated Local Government Areas (Egor, Oredo, Ikpoba Okha LGA) in Edo –South Senatorial District, out of the 18 LGAs in the 3 Senatorial Districts of Edo State. Purposive sampling techniques and simple random sampling techniques were employed in selecting the sample for the study. This study was limited to only sixteen (16) secondary schools thirteen (13) government secondary schools and three mission secondary schools in Benin City because only these schools had practicing school counsellor(s) as at the time the study was carried out. In all, there were four hundred and twenty respondents (420). Sex was not a factor in the study. 2.1. Instrumentation Two different four-point Likert type scale questionnaires were designed by the researcher to obtain data for the study. These are: (1) Secondary School Counsellors’ Questionnaire (SSCQ); (2) Secondary School Students’ Questionnaire (SSSQ) The SSCQ consisted of two main sections viz: Section ‘A’: This consisted of three items requesting information about the level of qualification in guidance and counselling from the respondents. Section ‘B’: This consisted of five items requesting information about the availability of guidance and counselling facilitiesmaterials in the school. The SSSQ also consisted of two sections viz: Section ‘A’: This consisted of eleven items eliciting information about the quality of guidance services rend by counsellors in the school from the respondents. Section ‘B’: This consisted of twelve items requesting information about the impact of guidance and counselling services on Nigerian secondary school students’ adjustment. The respondents in each case were requested to indicate the extent to which they agreed or disagreed to each item. Items one to three in section â€Å"A† of the SSCQ and items one to eleven in section â€Å"A† of the SSSQ were used to test hypothesis one. Items one to five in section â€Å"B† of the SSCQ and items one to eleven in section â€Å"A† of the SSSQ were used to test hypothesis two. Items one to eleven in section â€Å"A† of the SSSQ and items one to twelve in section â€Å"B† of the SSSQ were used to test hypothesis three. The scoring of the instruments was as follow: Strongly Agree (SA)-4 Agree (A)-3 Disagree (D)-2 Strongly Disagree (SD)-1 For all positive worded items the above was the case, while the reverse was the case for all negative worded items in the questionnaire. 2.1.1. Validity and Reliability of the instruments Both construct and face validity was established. The reliability of 0.69 and 0.67 were obtained respectively for sections A and B of the instrument for Counsellors (SSCQ) using the Cronbach Alpha Internal Consistency reliability test. The Students’ Questionnaire (SSSQ) yielded an alpha coefficient of reliability 0.80. 2.1.2. Administration of the instruments Permission was obtained from the school before administering the questionnaires, which were personally administered by the investigator to the respondents in the various secondary schools selected for the study. 2.2. Adverse effects of the PPT rule In the EU context, the ECJ case law cannot be ignored to interpret anti-abuse provisions such as the PPT rule. Apart from settle case law, I considered the recent decisions on French and German anti-abuse rules confirming the ECJ’s adherence to the familiar wholly artificial arrangement test. Abuse is considered to exist if the setting up of an intermediate or other holding company qualifies as wholly artificial arrangements. This is the case if the facts show that setting up or maintaining the holding company does not correspond to the freedom of establishment’s intended aim of promoting economic integration. For this to exist, a company must pursue genuine activities for an indefinite period through a fixed establishment in another Member State. This in turns requires the existence of premises, staff and equipment to carry out economic activities. The question of what facilities can be considered to constitute a sufficient physical presence depends on the nature of th e activities pursued. These facilities must in any event be proportionate for the activities that are to be carried out. Instead, passive activities, such as certain holding company activities, generally require few facilities. The further requirement is for the entity to perform genuine economic activities. Passive activities can in principle satisfy this requirement, unless the activities are so marginal that they can no longer be regarded as bearing any relationship to economic reality. It could potentially be concluded from the ECJ case law that pursuing passive activities without any accompanying provision of services does not constitute a genuine economic activity. The absence, therefore, of any services provided by the intermediate or other holding company to a group company or third party could suggest the lack of a link to economic reality. If arrangements are to qualify as abuse – and, therefore, as lacking an establishment – it also has to be determined whether the parent company was objectively seeking to obtain a tax advantage by setting up the secondary establishment. This will be the case if the facts demonstrate that the arrangements could not have any purpose other than a wish to escape tax. An aspect of critical importance is the link that a company has with the host Member State through its pursuit of genuine economic activities, whereby the term ‘genuine economic activities’ has to be interpreted widely. Even activities of a more passive nature, such as certain holding company activities, can in principle be covered by this term, providing the intermediate or other holding company has sufficient physical presence to perform the activities and the arrangements have not been put in place solely for the purposes of avoiding tax. Finally, I tried to exemplify the adverse effects that the PPT may generate in practice by simulating the application of the rule to an equity wall structure. I showed the reasons why the PPT rule may represent a stronger weapon in the hands of tax authorities.
